The United States Supreme Court ruled in a 6-3 decision that states have the right to deny transgender women and girls from participating in school athletics on Tuesday. The decision was made based on concerns about safety and fairness.
States like Idaho and West Virginia have already banned transgender athletes from being involved with sports and this decision rules that those bans do not violate the constitution. It was also agreed on by the court that this does not violate Title IX — which prohibits sex discrimination in education.
In November of 2025, The Supreme Court also ruled that transgender or nonbinary individuals are not allowed to choose their gender markers on passports.
Other laws about transgender individuals have been being passed at the state level as well. In Kansas, a bill was passed in February that required people to use bathrooms that align with their assigned sex at birth. Then in March, about 1,700 Kansans had their drivers licences revoked for having gender markers that don’t align with their sex at birth.
In February of 2025, Kansas legislators also passed a bill banning gender affirming care for minors.
