An emergency injunction was filed by the Student Government Association’s Supreme Court concerning the recent Hispanic American Leadership Organization presidential election on April 28.
According to SGA’s adviser Gabriel Fonseca, a student running for a HALO position reached out to him because the student believed HALO was not following their election procedure correctly. The student later filed a formal complaint with the court.
“In the conversation I had with this student, I think he kind of provided some information that maybe potentially sounded that it (the election) was different,” Fonseca said. “With how the elections are, I don’t know 100% how it all worked out, but we saw the case last night (April 28) with the court.”
Wednesday, April 29 was when HALO was supposed to begin its transition to the newly elected student leaders, but because the court began looking into the case the transition of power will not happen until the issue is resolved.
Fonseca said that the court will meet on Monday to review the full case. There has not yet been a decision on whether a hearing will be held or if the court will review based on the information in the complaint.
Only one party, the student who filed the complaint or HALO’s current president, has to request a hearing and they have until Friday to request one. If a hearing is requested, the court will decide on a date during their meeting on Monday.
“The court, they can either uphold the election based off of if the evidence that was submitted or the case that was presented doesn’t appear to violate HALO’s rules,” Fonseca said. “… The other option is that they can throw out the election and make them do it again.”
In a similar case last August, the Supreme Court voided the election results of the International Student Union, based on several violations of ISU’s election rules.
